APPROVED: Chairman of the Board of the NGO "Dnipro Regional Association "Power of the Future" (Order No. 1 of January 02, 2020)The following Code of Ethics and Conduct (hereinafter referred to as the "Code") of the Dnipro Regional Association "Power of the Future" (hereinafter referred to as the "NGO" or "Association") reflects the principles of honesty, integrity, social and conflict sensitivity to all persons cooperating with the NGO, as well as to all other persons with whom the Association interacts.This Code contains the main policies of behavior and ethics aimed at ensuring and protecting human rights and dignity, consideration of gender aspects in work, freedom and interests of any person, regardless of sex, age, gender, religious beliefs, orientation and other factors.This Code does not replace the main Regulations and internal policies of the Association, but is a combination and excerpt of the policies on the issues and categories listed above.
GENERAL PRINCIPLES
This Code consists of categories that include guidelines for behavior in all areas of the Association's activities:- Responsibility and Reliability: The obligation to perform our duties responsibly and reliably, in compliance with established standards.- Confidentiality and Secrecy: Protecting confidential information and maintaining secrecy in all aspects of work.- Objectivity and Independence: Ensuring objectivity and independence in decision-making and operations.- Professionalism and Excellence: Demonstrating the highest level of professionalism and commitment to achieving the highest quality in all aspects of work.- Respect: Promoting a positive and respectful attitude towards all individuals in the work environment.- Integrity: Adhering to high standards of integrity and honesty in all dealings and interactions with others.
OBJECTIVES OF THE CODE
The Code defines the following tasks:- Promoting the achievement of the goal of the NGO and its statutory tasks: Active support for achieving the goals and objectives of the Dnipro Regional Association "Power of the Future".- Realization of collective opportunities of persons cooperating with the NGO: Ensuring the rights and opportunities of persons cooperating with the Association through collective initiatives.- Ensuring effective performance of duties and active work;- Promoting the conscious fulfillment of duties and active participation of persons in solving problems;- Formation of ethical and business standards of behavior;- Development of ethical standards and compliance with them in interaction and activities within the Association;- Fostering mutual respect and honesty;- Strengthening the values of mutual respect, honesty and objective assessment of the actions of colleagues and outsiders;- Ensuring cohesion and teamwork;- Promoting unity of persons cooperating with the NGO, strengthening the team and active support of the rights and interests of the members of the NGO.
CONFLICT OF INTEREST PREVENTION POLICY
Definition of a conflict of interestA conflict of interest arises when there is a conflict between the personal interests and official duties of a person holding a responsible position. A real or perceived conflict of interest may have a negative impact on the organization's activities and the tasks it sets itself.Purpose of the PolicyThis Policy provides assistance to the head and employees of the NGO in identifying actual or potential conflicts of interest. It also establishes a set of procedures that, if followed, will help to avoid conflicts or successfully resolve them.Principles of the Policy- Fairness and transparency: Employees are committed to the principles of fairness and transparency.- Careful use of suppliers' services: Employees should refrain from inappropriate use of services of companies where their family members work.- Procurement precautions: When organizing procurements and visiting suppliers, it is important to take measures to avoid the possibility of a conflict of interest. If necessary, the approach of completely excluding a supplier from the register of potential suppliers is used.
Liability for conflicts of interest
Issues related to conflicts of interest are serious and may result in liability, including termination of contracts and relationships.Every employee is required to identify and discuss any potential conflicts of interest.Privacy:Each person in the organization undertakes not to disclose confidential information obtained in connection with a real or potential conflict of interest, and the disclosure of which may adversely affect the interests of the organization. In addition, any person in the organization will not disclose or use information related to the organization's activities for personal gain or the gain of a family member.Each new person hired by the organization undertakes to:- Familiarize yourself with the rules for protecting confidential information.- Comply with the procedure for filing an annual conflict of interest declaration regarding any relationship, position or circumstance that may give rise to an actual or potential conflict of interest.Such relationships, positions or circumstances may include consulting services for the organization or ownership of an enterprise that may provide goods or services to the organization. Any such information relating to the business interests of the responsible person or a family member will be treated as confidential and will generally be made available only to the chairperson designated to deal with conflicts of interest.This conflict of interest policy is subject to revision. Any change in the policy will be immediately communicated to all responsible persons.Bribes / commissions / giftsAn employee of the organization may not demand or accept bribes, valuable gifts, favors or other financial rewards from contractors, beneficiaries and participants of projects, partners or other parties. Business meetings with suppliers are reasonable and acceptable, provided they are justified. They are conducted on a transparent and reasonable basis, where any actions and decisions taken are aimed at ensuring honesty and ethical relations with suppliers.
ANTI-FRAUD AND CORRUPTION POLICY
The NGO adheres to high legal and ethical standards. We expect that all employees, as well as consultants, contractors, partner organizations and any other parties that have financial or fiduciary relationships with the NGO, share this commitment. The purpose of this Policy is to set out the NGO's policy on the prevention and detection of fraud and corruption, as well as the procedures to be followed when fraud or corruption is detected or suspected. Every incident of fraud or corruption will be treated with zero tolerance.Terms and definitions:Bribe: Money, services or gifts accepted by an employee for an action/inaction in the interests of the bribe giver.Zero Tolerance Principle: A declaration that all employees and other persons interacting with the CSO are guided by the principle of "zero tolerance" to any form of corruption and bribery.● Business hospitality: Business breakfasts, business lunches, dinners, treats, corporate or other events.● Business gifts: A material value that is given to a business partner at the expense of the NGO.Conflict of interest: A contradiction between an employee's personal interest and functional responsibilities in the CSO.Fraud: Deception to obtain an unfair or unlawful financial gain or other unfair advantage.Corruption: A type of misconduct in the form of bribery, bribe-taking, abuse of power, etc.● Undue advantage: Money or other property obtained without legal authority.Subordination: A relationship of dependence between a subordinate and his/her supervisor.These concepts are defined for the purpose of clarity and unambiguity, so that all participants have a clear understanding of the anti-fraud and corruption policy within the organization.
Anti-corruption control and measures
Procurement processes:1. Strict requirements for conflicts of interest and communication with tenderers are ensured.2. Before starting the procurement process, the employee must comply with internal documents and consult with the Chairman to avoid violations.3. A comprehensive due diligence of business partners is conducted to assess corruption risks.4. It is prohibited to fulfill/receive extra-contractual conditions in cooperation with partners.Partners and representatives:1. It is prohibited to engage representatives for transactions that violate anti-corruption legislation.2. Making corrupt payments through representatives or payments to a third party is prohibited.3. Conducting a mandatory check of a potential representative before entering into an agreement.4. Prohibiting employees or representatives from influencing government officials.Interaction with government officials and politicians:1. Prohibition of offering money, gifts or other benefits to public officials and politicians.2. Expenditures for political purposes are prohibited as they may lead to corruption charges.3. The NGO does not reimburse expenses related to personal donations of employees for political purposes.Charity, sponsorship, social responsibility:1. Prohibition of charitable contributions that may influence public officials or other persons.2. All contracts/payments must comply with the current NGO Policy.Financing of political parties:1. Political expenditures are prohibited as they may lead to corruption charges.Accounting and financial reporting:1. Ensure complete and accurate reporting and accounting records are maintained.2. Employees sign only those documents that they are authorized to sign and that are accurate.Disclosure of conflicts of interest:1. An employee must inform his/her manager of a conflict of interest and refrain from acting until the matter is resolved.2. The decision to regulate the conflict of interest is made by the Chairman of the Board.3. Employees shall report any conflict of interest of other employees or third parties.
POLICY OF PROTECTION AGAINST SEXUAL EXPLOITATION AND ABUSE
The NGO "Power of the Future" is concerned about safety and inviolability in the field of protection against sexual violence in any form.Problems and Challenges:Until recently, information on cases of sexual and gender-based violence was incomplete due to stigma, a culture of silence, legal deficiencies, limited access to justice and investigative challenges. Today, these problems have become more apparent, including due to the lack of clear definitions in legislation and limited forensic services.Violence in the Context of Conflict:Economic hardship, armed conflict, and displacement have exacerbated the situation, increasing the risk of sexual violence. Gender-based violence, especially against women and girls, is exacerbated by inequalities in society and discrimination.Legal Basis:The Power of the Future NGO is guided by the current legislation.In its activities, within the framework of this Strategy, the Power of the Future NGO adheres to the following norms of the current legislation.The Constitution of Ukraine Art. 3 A person, his or her life and health, honor and dignity, inviolability and security are recognized in Ukraine as the highest social valueArticle 28 Everyone has the right to respect for his or her dignity. No one shall be subjected to torture, cruel, inhuman or degrading treatment or punishment. TYPES OF UNACCEPTABLE SEXUAL BEHAVIOR
Types of unacceptable sexual behavior include all forms of inappropriate sexual behavior by assistance personnel and other persons cooperating with the Power of the Future NGO. Prohibited behavior includes, but is not limited to, the following actions:- Sexual relations with a child (a person under the age of 18): Even in cases where the child appears to be older than 18, this is not an excuse. Staff and other employees are prohibited from having sexual relations with anyone under the age of 18.- Exchanging money, employment, goods or services for sex or other sexual activity: It is forbidden to provide money, food, employment, goods, assistance or services in exchange for sex or other sexual activities.- Sexual relations with prostitutes: Prohibited, even in countries where it is officially legal.The types of unacceptable sexual behavior include the following:- Sexual exploitation: The actual abuse or attempted abuse of a position of vulnerability, power, or trust to gain advantage through the sexual exploitation of another person.- Sexual abuse: The abuse of a position of vulnerability, power or trust to obtain sexual favors, including the commission or threatened commission of sexual acts of a violent or coercive nature.- Sexual harassment: Unwelcome conduct of a sexual nature that is intended to humiliate or offend a person or create a corresponding effect, including verbal and physical expressions.These prohibitions and standards are intended to ensure the safety of all participants and to uphold the highest social values as defined by the Constitution of Ukraine and other legal acts.
POLICY FOR THE PROTECTION OF SOCIALLY VULNERABLE PERSONS GUARANTEES FOR THE SAFETY OF SOCIALLY VULNERABLE PERSONS PROVIDED BY THE PUBLIC ORGANIZATION "FORCE OF THE FUTURE"
The Power of the Future (POF) recognizes and upholds the inalienable right of every human being to live free from violence and exploitation. We are committed to guaranteeing this right by implementing and maintaining a robust security system.POF is committed to fully supporting the protection of socially vulnerable persons, regardless of age or gender, and to taking all possible measures to ensure their safety. We are committed to implementing reasonable and effective measures aimed at protecting socially vulnerable groups, including youth and the elderly.POF is responsible for implementing measures aimed at protecting the safety of socially vulnerable persons and for creating a working environment where children, youth and socially vulnerable adults can be confident in their safety. We support the collective efforts of the management, employees and all POF members to create and develop an appropriate organizational culture.POF recognizes its obligation to respond to any allegations, reports or suspicions of abuse (physical, sexual or emotional) by management, employees or any POF member or representative of a partner organization.POF provides financial and other support to partner organizations that provide programs and services for various socially vulnerable groups.We believe that every person who uses the services of POF or its partners has the right to be protected from violence, regardless of age, culture, disability, gender, race, language, religious beliefs or sexual orientation.The management, employees and all participants of the POFare obliged to adhere to the principles of safety of socially vulnerable persons in their work and behavior:- The right to protection from abuse: Every person has the right to be protected from abuse and exploitation, regardless of various social factors.- The right to a decent, healthy and safe life: We are committed to ensuring that all socially vulnerable people who use our services have the opportunity to lead a decent, healthy and safe life.- Guaranteed protection from violence: The management, staff and participants of the POF are obliged to guarantee the protection of socially vulnerable persons from any kind of violence.
